DwDG ("DwDG", "we", "us" or "our") is committed to respecting the privacy rights and concerns of all users of the DwD service provided on or through our websites, including www.downwithdestruction.net (the “Site(s)”), and on or through software applications made available by DwD (we refer to the Site(s) and such software applications made available by DwD as the “Service Applications” and we refer to the Service Applications and the services made available through the Service Applications collectively as the DwD Features”). What information do we collect about you and how do we use it?
I. Types of Information We Collect
Personal information means information that can be used to identify and contact you. You do not need to submit personal information to access our Site(s), but if you do not want to disclose certain personal information to us, you will not be able to access certain aspects of the DwD Features.
We collect personal information when you create an account through the DwD Features; subscribe to our packages; utilize voice communication tools made available through the DwD Features; participate in chat rooms, forums, polls, surveys, and questionnaires; participate in contests, sweepstakes, other promotions, or opt into third party offers and/or packages; purchase a product through the DwD Features; register a product that you have purchased; or receive customer or technical support.
To create an account for the DwD Features, we require you to provide your name, email address and country in which you reside. You will also need to create a screen name. When you are purchasing premium services or products through the DwD Features you may have to submit personal information to our billing partner, PayPal, including your email address, billing address and additional billing information depending on your preferred method of payment through PayPal, such as your credit card number. When you enter a contest or sweepstakes with DwD, in addition to your screen name, name and email address, we will ask for your mailing address in case we have to mail you a prize, and may ask you to opt into receiving a third party’s offers and/or packages.
Additionally, we may also collect other types of information (known as demographic information) such as your gender, hobbies, occupation, platform preferences, and other game ownership information. This demographic information may be associated with your personal information.
We also offer features that allow you to link your account to third party social networking sites through the DwD Features, such as Facebook. If you sign up for one of these services, we may also collect personally information from these Internet sources and database services.
Through the DwD Features, you may be able to link to technology, software and services owned and controlled by third parties (the “Third Party Features”). You may be permitted or required to submit personal information to access Third Party Features. Such use of Third Party Features and submission of information through Third Party Features will be subject to such applicable third party’s terms of use, terms of service and/or privacy policy. You agree to look solely to the applicable third party and not to DwD to enforce your rights in relation thereto.
By submitting personal information through the DwD Features, you authorize DwD to share this personal information for the purposes identified herein and as described in the DwD Features, such as responding to user inquiries and processing transactions.
II. How We Use Your Personal Information
The personal information you provide to us will allow us to fulfill your product or service order; alert you of new products or services, features, or enhancements; handle/route your customer service questions or issues; and/or notify you of upgrade opportunities, contests, promotions, or special events and offers. We also use your e-mail address to send you messages about the DwD Features and other general announcements. Additionally, personal information you make public will be viewable by other users of the DwD Features. We keep track of your interactions with us, including but not limited to your activity within the DwD Features. We may use personal information that you provide to us to send messages to you in response to your request to perform an activity in connection with your use of any of the DwD Features. You grant us a royalty-free, worldwide, perpetual, irrevocable and fully transferable right and license to use your de-personalized information in connection with the creation and development of analytical and statistical analysis tools relating to the use of the customer data we collect in providing the DwD Features (the “Analytical Data”). We are expressly authorized to make any commercial use of the Analytical Data, including without limitation, sharing the Analytical Data with third parties, provided that we do not sell, trade, or otherwise transfer from us any part of the Analytical Data that personally identifies you in any way.
III. Cookies
“Cookies” are small bits of electronic information that a website sends to a visitor’s browser and are stored on the visitor’s hard drive. Like many websites, we employ cookies in certain areas of the DwD Features to allow us to provide information which is targeted to your interests and to make your online experience more convenient. VI. Log Information
Our servers automatically record information that your browser sends whenever you visit our Site(s). Additionally, some of the DwD Features may collect information regarding your computer system. This information includes your Internet Protocol address, your browser type and version, the search engine you used to find the DwD Features, if any, the operating system your computer uses, the type of computer hardware you have (such as the amount of RAM, the type of GPU or type of CPU in your computer) which DwD Features you use and when and how long you use them. We use this information to monitor and analyze how users use the DwD Features, to provide customer service and to maintain and improve the DwD Features.
VII. Children’s Privacy
The DwD Features are expressly not intended for children under the age of 13. We do not knowingly collect or maintain any personal information or non-personally-identifiable information from anyone under the age of 13 nor is any part of our website, software or service directed to children under the age of 13. We will close any accounts used exclusively by such children and will remove and/or delete any personal information we believe was submitted by any child under the age of 13.
Will we share your personal information with third parties?
I. Sharing of Information
We may use your personal information to provide analyses of our users in the aggregate (including the Analytical Data) to prospective partners, advertisers and other third parties. We may also disclose and otherwise use, on an anonymous basis, affiliation, position, interests and other non-personal information about customers.   • Service Providers. We may share your personal information with service providers that we engage for the purpose of processing information on our and your behalf. For example, we have semi-partnered with other companies to host and manage donations, fulfill premium product orders, and process payments. Additionally, we may partner with other companies to process consumer surveys, or to process, analyze, and/or store data, including, but not limited to, Analytical Data. While providing services for us, these companies may access your personal information. II. Additional Information About Third Parties
The DwD Features may contain direct links to websites operated by our business partners and other third party entities. These third party websites may collect information about you when you visit them or otherwise communicate with them. This Privacy Policy does not cover the information practices of third party websites linked to the DwD Features or third party offer opt-ins provided through the DwD Features. Although we encourage such third parties to adopt and follow their own privacy policies, we are not responsible for their collection and use of your personal information. When you have clicked on an advertisement or third party logo or URL displayed on our Site(s) or accessible through the DwD Features which links you to a different website, our Privacy Policy no longer applies and you must read the privacy policy of the third party to see how your personal information will be handled on their website.
The DwD Features may also have message boards, forums and/or chat areas, where users can exchange ideas and communicate with one another. When you post to a message board, forum or chat area, please be aware that the information you post is made publicly available on-line and you do so at your own risk.
What choices do you have about the collection and use of your personal information?
I. Control of Your Information
We may use third-party advertising companies, such as Yahoo! and Google to serve ads when you visit the DwD Features. These companies may use information about your interests in order to provide advertisements about goods and services of interest to you. You may update or delete your personal information or modify your account preferences for the D Features by accessing the “Account Settings” area of the DwD Features or sending us an email to contact@downwithdestruction.net requesting us to update or delete your personal information. However, information previously shared with other users through a chat room, forum or otherwise may not be deleted. Please note that when you delete your account, we may retain your account information for a reasonable period of time afterward for the purpose of internal account management and fraud prevention activities.
II. Opting Out of Receiving Communications from Us
If you no longer want to receive our e-mail notifications or other announcements, you may opt-out by unchecking “receive email notifications of replies” in your account settings (Preferences), and by unchecking any of the "Messaging Preferences" in your account settings (Contact Details). Please note that you cannot unsubscribe from certain service related correspondence from us, including messages relating to your account transactions. If you wish to unsubscribe from any newsletters, offers, e-mails or other announcements from our third party advertising partners that you have opted into through the DwD Features, you will need to contact such third party advertising partner directly through their independent website(s) or by clicking on the unsubscribe link at the bottom of any such emails (if any).
III. Mediation
If you are a resident of a country outside of the European Union, you also agree that, in the event any dispute or claim arises out of or relating to this Privacy Policy that you and DwD will attempt in good faith to negotiate a written resolution of the matter directly between the parties. You agree that if the matter remains unresolved for forty-five (45) days after notification (via certified mail or personal delivery) that a dispute exists, all parties shall join in mediation services in Philadelphia, Pennsylvania with a mutually agreed mediator in an attempt to resolve the dispute. Should you file any arbitration claims, or any administrative or legal actions without first having attempted to resolve the matter by mediation, then you agree that you will not be entitled to recover attorney’s fees, even if you would otherwise be entitled to them.
IV. Dispute Resolution for Residents of the European Union
If you are a resident of the European Union, in the event that you have any dispute or claim arising out of or relating to this Privacy Policy, you may, in addition to, or instead of, contacting us in the first instance, report your claim to the Data Protection Authority located in your jurisdiction.
What security measures do we take to safeguard your personal information?
The personal information that you provide to us is stored on servers, which are located in secured facilities with restricted access, and protected by protocols and procedures designed to ensure the security of such information. In addition, we restrict access to personal information to DwD employees, independent contractors and agents who need to know this information in order to develop, operate and maintain the DwD Features. All DwD personnel who have access to this information are trained in the maintenance and security of such information. However, no server, computer or communications network or system, or data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect user information, we cannot ensure or warrant the security of any information you transmit to us or through the use of any of the DwD Features and you acknowledge and agree that you provide such information and engage in such transmissions at your own risk. Once we receive a transmission from you, we will endeavor to maintain its security on our systems.

THE PERSONAL INFORMATION THAT YOU PROVIDE TO US MAY BE TRANSFERRED TO, PROCESSED AND STORED IN THE UNITED STATES OF AMERICA AND/OR OTHER JURISDICTIONS OUTSIDE OF THE EUROPEAN ECONOMIC AREA (“EEA”).
